Terms of Service

These Terms of Service (“Terms”) govern your access to and use of GlassDesk, including the web dashboard, the embeddable chat widget, the mobile app, and related services (together, the “Service”), provided by GlassDesk Inc. (“GlassDesk,” “we,” “us,” or “our”). By using the Service you agree to these Terms. If you use the Service on behalf of an organization, you agree to them on that organization’s behalf and confirm you have authority to do so.

1. Accounts

You must provide accurate information when creating an account and keep it up to date. You are responsible for keeping your credentials secure and for all activity under your account. Tell us promptly if you believe your account has been compromised. Organization administrators are responsible for the accounts they create and the permissions they grant.

2. Acceptable use

You agree not to:

  • use the Service for anything unlawful, fraudulent, or harmful;
  • send spam or unsolicited messages, or content that is abusive, harassing, or infringes the rights of others;
  • upload malware or attempt to disrupt, overload, or gain unauthorized access to the Service or other accounts;
  • reverse engineer the Service except where the law allows it; or
  • resell or provide the Service to third parties except as we allow in writing.

We may suspend or restrict access where we reasonably believe these Terms have been broken or the Service is at risk.

3. Your content

You keep ownership of the content you and your organization put into the Service, including tickets, messages, recordings, and files (“Customer Content”). You grant us a limited licence to host, process, transmit, and display Customer Content only as needed to provide and support the Service. You are responsible for having the rights and any consents needed for the Customer Content you submit, including notices to your own customers where you record calls or use chat.

4. Privacy

Our Privacy Policy explains how we handle personal information. Where we process personal information on your organization’s behalf, we do so under your instructions.

5. Third-party services

The Service may connect to third-party services, such as email providers, telephony, or AI models, that you choose to enable. Your use of those services is subject to their own terms, and we are not responsible for them.

6. Fees

If your plan has fees, you agree to pay them as described at sign-up or in your order. Unless stated otherwise, fees are non-refundable, and we may change them with reasonable advance notice.

7. Availability and changes

We work to keep the Service available and reliable but do not guarantee it will be uninterrupted or error-free. We may change, add, or remove features over time. If we make a change that materially reduces the Service, we will give reasonable notice where practical.

8. Intellectual property

The Service, including its software, design, and trademarks, belongs to GlassDesk and its licensors. These Terms do not give you any rights to it beyond using the Service as allowed here. If you send us feedback, we may use it without obligation to you.

9. Termination

You may stop using the Service at any time. We may suspend or end access if you break these Terms, if required by law, or if we stop offering the Service. On termination your right to use the Service ends; we will make Customer Content available for export for a reasonable period where practical, after which it may be deleted.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-assisted features may produce inaccurate output and should be reviewed before use.

11. Limitation of liability

To the fullest extent permitted by law, GlassDesk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose.

12. Indemnity

You agree to defend and indemnify GlassDesk against claims arising from your Customer Content, your use of the Service in breach of these Terms, or your violation of law or the rights of others.

13. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, give reasonable notice. Continuing to use the Service after changes take effect means you accept them.

14. General

These Terms are the entire agreement between you and GlassDesk about the Service, unless you have a separate signed agreement with us, which will take precedence. If any part is found unenforceable, the rest remains in effect. Failing to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms are governed by the laws of the jurisdiction in which GlassDesk Inc. is organized, excluding its conflict-of-laws rules.

15. Contact

Questions about these Terms can be sent to [email protected].
